Oklahoma Supreme Court Decides on AMA Guides

In Robert Hill v. American Medical Response, 2018 OK 57,the Oklahoma Supreme Court ruled that the mandatory use of the “latest edition of the AMA Guides”, which is currently the AMA Guides 6th Edition, to rate for impairment to the Whole Body does not violate Oklahoma’s constitutional guarantee of due process, equal protection, and access to a remedy. This ruling applies to all non-scheduled members, which primarily consists of the spine, hips, shoulders and head.

We can now expect all cases that had been “reset when ready” pending this decision to proceed to trial on the issue of permanent partial disability.
