David F. Menghini

David Menghini handles workers' compensation matters in the education, government, and manufacturing sectors. His expertise is evaluating claims and developing defense strategies to minimize exposure, as well as dealing with labor and employment related issues. Mr. Menghini works closely with employers and to help them develop return-to-work programs for injured workers with temporary restrictions. His understanding of workers' compensation claims requiring Medicare set-aside compliance allows him to address Medicare issues during litigation, as well as in workers' compensation settlements. Mr. Menghini also represents Indian tribes in workers' compensation proceedings.

His experience includes workers’ compensation claims resulting from assaults, violent acts, back injuries, fatalities, head injuries, heart attacks and infectious diseases, psychological and mental disorders, muscular skeletal disorders, neck injuries, paraplegia and quadriplegia, permanent disability, pulmonary disorders and respiratory conditions. He frequently argues before the Missouri Labor & Industrial Relations Commission and the Kansas Workers’ Compensation Appeals Board.

Mr. Menghini successfully defended one of the employers in Markovich v. McCoy Enterprises, a Kansas Court of Appeals decision defining two upper extremity injuries as scheduled injuries and not as a body as a whole injury. He effectively argued that a Missouri injured worker was not entitled to permanent total disability benefits if the claimant’s employment status was significantly impacted by his addiction to pain medication. He successfully argued that an Indian tribe’s sovereign immunity prevented a Kansas Administrative Law Judge from asserting state jurisdiction over the tribe.

Mr. Menghini is a shareholder at McAnany, Van Cleave & Phillips and currently serves on the firm’s Board of Directors. Prior to working with the firm, he was a property manager for Hill Partners, Inc. and served in the Volunteers in Service to America. Mr. Menghini is a cancer survivor and has been a member of the Cancer Action Board of Directors and regularly volunteers for the American Cancer Society. He is a member of the Knights of Columbus and is active at Sacred Heart Church. He and his wife, Beth, have four daughters and one son, who account for most of his free time.
